A San Francisco federal district judge has just overturned Prop 8, the voter-approved ban on gay marriage in California. Federal Judge Vaughn Walker ruled Prop 8 unconstitutional.
Gay supporters are celebrating. Opponents are crying foul.
Why?
Not because he is a Republican appointee (President George H. W. Bush) or that his appointment was vociferously opposed by then San Francisco Congresswoman Nancy Pelosi.
The reason supporters of Prop 8 are crying foul is Judge Walker is openly gay.
That is a conflict of interest. This judge should have recused himself.
